These Terms of Service (the “Terms”) govern your access to and use of the website at yourdoctor-eg.com and all related content, features, products, and services (the “Services”) operated by YourDoctor (“YourDoctor”, “we”, “us”, or “our”). Our store is hosted on Shopify. By accessing or using the Services, or placing an order, you agree to be bound by these Terms and by our Privacy Policy and Return & Refund Policy, which are incorporated by reference. If you do not agree, please do not use the Services.

1. Eligibility & Accounts

You must be at least the age of majority in your jurisdiction, or use the Services under the supervision of a parent or legal guardian, to place an order. If you create an account, you agree to provide accurate and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.

2. Products, Descriptions & Availability

We take care to describe and display our products accurately. However, we do not warrant that product descriptions, colours, images, or other content are always accurate, complete, or error-free; actual colours and packaging may vary. All products are subject to availability, and we may limit quantities, discontinue any product, or change our range at any time before your order is accepted, without liability to you.

Independent retailer, no affiliation. YourDoctor is an independent retailer of genuine products, imported sealed. We buy the products we sell through ordinary commercial channels and resell them in Egypt. Brand names, logos and packaging shown on the Services are trademarks of their owners and are used only to identify the products we sell. YourDoctor is not affiliated with, endorsed by or sponsored by any brand, and we are not the agent, distributor or representative of any brand. See our Brands & trademarks page.

Back-in-stock notifications. Where a product or variant is sold out, you may leave your email address or phone number to be told when it returns. We use those details for that one purpose only: we send you a single message when the item is back, and we do not add you to any marketing list because of it. You can ask us to remove you at any time, and we delete the details once the notification has been sent or after 12 months, whichever comes first. See our Privacy Policy for the full data terms. A notification is not a reservation and does not hold stock for you.

3. Pricing

Prices are displayed in Egyptian Pounds (EGP) and are the total price you pay unless stated otherwise at checkout. Delivery charges, where they apply, are shown separately at checkout before you confirm your order. We make every effort to ensure prices are accurate, but errors may occur. If we discover a pricing error affecting your order, we will contact you and give you the option to proceed at the correct price or cancel the order. We may change our prices at any time, but the price shown when you place your order is the price of that order, except where an obvious pricing error is corrected as described above.

4. Orders & Acceptance

Your order is an offer to purchase. All orders are subject to our acceptance. We may accept or decline any order, in whole or in part, and may cancel an order after acceptance in cases including suspected fraud, pricing or stock errors, or where required by law. Where an order is cancelled and you have already paid, we will refund the affected amount in accordance with our Return & Refund Policy. If you need to change or cancel an order, contact us as early as possible on WhatsApp at +20 113 014 7058 or at support@yourdoctor-eg.com, since orders are passed to our courier soon after they are placed.

5. Payment

Cash on delivery is the only payment method we offer. There is no online payment at checkout: the full order total, including any delivery charge shown at checkout, is payable in cash to the courier at the moment your order is handed to you. Please have the exact amount ready. We do not ask for, receive, or store any card or bank details in order to take payment for an ordinary order, and we will never ask you for card details over WhatsApp, by email, or by phone.

The one payment that is made before delivery is the deposit on a custom order (Sections 8 and 25). You pay it by Instapay or bank transfer once you accept the total we message you, and the balance is still paid in cash to the courier on delivery. If we introduce another payment method in future, we will update these Terms before it goes live.

6. Shipping & Delivery

Orders are delivered Egypt-wide by our local courier partner. Estimated delivery windows by zone are 2 to 4 business days for Cairo and Giza, 4 to 6 for Alexandria and Beheira, 4 to 7 for the Delta and Canal, 5 to 9 for Upper Egypt and 7 to 10 for the Red Sea and Sinai (the Shipping Policy carries the fee per zone), and may extend around public and religious holidays (e.g. Eid al-Fitr, Eid al-Adha). Delivery times are estimates and are not guaranteed. We do not offer a live carrier-tracking link; status updates are provided by our courier via phone or WhatsApp and by order-status email from us. Full details are set out in our Shipping Policy. Please ensure someone is available to receive the order at the address provided. Nothing in this section limits your statutory rights as a consumer under Egyptian law.

7. Returns, Exchanges & Refunds

Returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms and sets out your rights, the applicable timeframes (including the 14-day return window for unopened, factory-sealed products and the 48-hour window to report a damaged, wrong, or defective item), and how to make a request: by WhatsApp at +20 113 014 7058 or at support@yourdoctor-eg.com. Because every order is paid in cash on delivery, a refund is paid back to you either in cash when the courier collects the returned item, or by Instapay or bank transfer within 7 working days where a cash handover is not practical. Nothing in these Terms limits your statutory rights as a consumer under the Egyptian Consumer Protection Law No. 181 of 2018 and its Executive Regulations.

8. Custom Orders

You may ask us to bring in any cosmetic, skincare, or personal-care product that is not listed on our site. Send us the product name, a link or a photo, the quantity and any details such as shade or size through the Special order page. We check the request, normally within 1 to 3 working days, and message you the total on WhatsApp or by email; the total covers the product, shipping and our special-order fee. Once you accept, you pay a deposit of at least 40% of that total by Instapay or bank transfer, we buy the item abroad and import it sealed, and the balance is paid in cash to the courier on delivery. A custom order is placed for you as a consumer, for your own use, and we source cosmetic, skincare and personal-care products only: we do not source medicines, prescription products, supplements requiring a prescription, or any item whose import into Egypt is restricted or prohibited, and we decline any request of that kind. Once the item is delivered to you, all of these Terms apply to it in the ordinary way, including Sections 5 (Payment), 7 (Returns, Exchanges & Refunds) and 25 (Custom Order Deposits).

9. Intellectual Property

All content on the Services: including the YourDoctor name and logo, text, graphics, images, designs, and the arrangement of them: is owned by or licensed to YourDoctor and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, or commercially exploit any content without our prior written permission.

Third-party brand marks. Brand names, logos and packaging that appear on the Services belong to their respective owners. We use them only to identify the genuine products we sell. Nothing on the Services transfers any right in those marks to us or to you, and nothing on the Services implies that YourDoctor is affiliated with, endorsed by or sponsored by any brand. YourDoctor is an independent retailer of genuine products, imported sealed. Brand owners with a question about how their marks appear here may write to support@yourdoctor-eg.com; see our Brands & trademarks page.

10. User Content

If you submit content to the Services (such as reviews, photos, or comments), you grant YourDoctor a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and adapt that content in connection with the Services and our marketing. You represent that you own or have the right to submit such content and that it does not infringe the rights of others or breach any law. We may remove content at our discretion. You can ask us to stop using content you submitted at any time by writing to support@yourdoctor-eg.com; we stop using it in new material.

11. Acceptable Use

You agree not to use the Services for any unlawful or prohibited purpose, including to: violate any law; infringe our or others’ rights; submit false or misleading information, including in a special-order request; interfere with or disrupt the Services or their security; attempt unauthorised access to any system or account; or use the Services to transmit malicious code. We may suspend or terminate access for breach of these Terms.

12. Third-Party Links

The Services may contain links to third-party websites or services that we do not control, including WhatsApp. We are not responsible for their content, policies, or practices, and their inclusion does not imply our endorsement. Your use of third-party sites is at your own risk and subject to their terms.

13. Disclaimers

The Services and products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, whether express or implied. We do not warrant that the Services will be uninterrupted, secure, or error-free. Nothing in this section excludes or limits any warranty, guarantee, or right that cannot be excluded or limited under applicable Egyptian law, including your statutory rights as a consumer.

14. Limitation of Liability

To the fullest extent permitted by law, YourDoctor will not be liable for any indirect, incidental, special, or consequential loss, or for loss of profits, arising out of or in connection with your use of the Services. Our total liability arising out of or relating to any order will not exceed the amount you paid for that order. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or gross negligence, or for any liability that cannot be excluded or limited under applicable Egyptian law, including the Consumer Protection Law No. 181 of 2018.

Because every order is paid in cash on delivery, any money we owe you under these Terms is paid back by the routes set out in our Return & Refund Policy: in cash when the courier collects the item, or by Instapay or bank transfer within 7 working days. We hold no card details and cannot reverse a card payment, so no clause in these Terms should be read as promising a card refund or a payment route we do not operate.

15. Indemnification

You agree to indemnify and hold harmless YourDoctor and its officers, employees, and partners from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party. This does not apply to any claim arising from our own act or omission, and nothing in this section requires you to indemnify us for the ordinary use of the Services or for exercising a right the law gives you. Any amount claimed under this section is limited to loss we actually suffer, is reduced by any loss we could reasonably have avoided, and never extends to indirect or consequential loss.

16. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

17. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you breach these Terms or where we reasonably consider it necessary to protect the Services, other users, or our rights. Provisions that by their nature should survive termination: including intellectual property, disclaimers, limitation of liability, indemnification, and governing law: will continue to apply. Suspending or ending your access does not cancel an order we have already accepted.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for operational, legal, or regulatory reasons. A change is published as a new version, with its own version number and effective date, and the version in force when you place an order governs that order. We give notice of a change before it takes effect, on this page. Changes apply from the effective date onwards; they do not change an order already placed.

19. Force Majeure

We are not liable for any failure or delay in performing our obligations where caused by events beyond our reasonable control, including natural events, strikes, failures of telecommunications or logistics networks, governmental actions, or other circumstances of force majeure.

20. Governing Law & Jurisdiction

These Terms are governed by the laws of the Arab Republic of Egypt. Disputes about them or about the Services are heard by the competent courts of Cairo. You may also complain to the Egyptian Consumer Protection Agency, free of charge, about anything in these Terms or any order. Complaining to the Agency does not take away your right to go to court.

21. General

These Terms, together with the policies referenced in them, constitute the entire agreement between you and YourDoctor regarding the Services, without affecting the information we are required by law to give you before you order, or any right you have as a consumer under Egyptian law. If any provision is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. You may not assign these Terms without our consent; we may assign them as part of a business transfer. These Terms are published in English and in Arabic. Both texts have the same effect; where they differ, the reading more favourable to you as a consumer applies.

22. Product Use, Health & Safety

YourDoctor is an online retailer of imported cosmetics, skincare, and personal-care products. We are not a pharmacy, and no member of our team is a doctor, pharmacist, dermatologist, or other healthcare professional. Nothing on the Services, in a product listing, on our social channels, or from our AI product guide (Section 24) is medical advice, a diagnosis, or a substitute for consulting a qualified physician or pharmacist: always do so before use if you are pregnant or breastfeeding, have a skin condition, are using a prescription treatment, or are unsure whether a product is right for you.

Before first use of any new product, perform a patch test: apply a small amount to an unaffected area of skin (such as the inner forearm) and wait 24 to 48 hours. Discontinue use immediately and seek medical attention if you experience redness, itching, burning, swelling, or any other sign of irritation or allergic reaction. Always read and follow the product label and manufacturer instructions before use, including active-ingredient concentrations, frequency of use, and sun-exposure precautions. Products containing retinoids, retinol, or similar actives, and any product we flag as an OTC drug (Section 23), are not intended for anyone under 18 and should not be used during pregnancy or while breastfeeding without first asking your doctor.

23. Regulatory Status of Products

Products sold by YourDoctor are original, sealed items imported from the United States (or the brand’s stated country of origin) and are not manufactured, reformulated, or repackaged by us. Their regulatory status is:

  • Cosmetics (the majority of our catalogue) are not, and cannot be, “FDA-approved”: the US Food and Drug Administration does not approve cosmetic products before they reach the market. A cosmetic being genuine and imported sealed from the US does not mean it carries FDA approval, because no such approval exists for that product category.
  • Certain products (for example, benzoyl-peroxide acne treatments such as PanOxyl) are regulated in the United States as over-the-counter (OTC) drug products under an FDA OTC drug monograph. These products follow their US labelling, including the Drug Facts panel, directions, and warnings printed on the pack; we do not alter or translate that labelling.
  • Egyptian regulatory position: we sell cosmetics, skincare and personal-care products only. We do not sell medicines, prescription products or medical devices, and we refuse any item whose import into Egypt is restricted or prohibited by the Egyptian Drug Authority (EDA) or by any other authority. The products we sell are genuine goods bought through ordinary commercial channels and imported sealed in their original packaging. We hold no appointment, agency, distribution right or licence from any brand, and we do not represent that any Egyptian registration has been granted to us for any particular product. If a competent authority tells us that a product may not lawfully be offered for sale in Egypt, we withdraw it from sale.

24. AI Assistant / Product Guide

Where enabled, our website offers an automated AI assistant (“product guide”) that answers general questions about our products and store. The assistant is automated software, not a person and not a healthcare professional. Its answers are generated from available product information and general knowledge, are provided for general informational purposes only, may be incomplete, outdated, or incorrect, and are never medical advice or a substitute for consulting a qualified physician or pharmacist. You should not rely on the assistant’s answer as the sole basis for a purchasing or health-related decision; where in doubt, contact our team on WhatsApp at +20 113 014 7058 or ask your doctor.

We log conversations with the assistant to operate, review, and improve the feature, as described in our Privacy Policy. To the fullest extent permitted by law, our liability for any loss arising from your use of, or reliance on, the AI assistant is limited to the amount you paid for the order the conversation relates to (or, if none, is excluded to the fullest extent the law allows), and we are not liable for any loss arising from your misuse of the assistant, including submitting it false information or using its output for a purpose it was not intended for. This section does not limit any liability that cannot be excluded under Egyptian law.

25. Custom Order Deposits

You may cancel and receive your deposit back in full at any time before we buy the item abroad. Once we have bought it, we return your deposit less only the costs we have actually and reasonably incurred on your order (the supplier price we cannot recover, international shipping already paid, and any customs or clearance charge already paid); we show you the evidence for every cost we deduct, we deduct nothing else, and we return the balance within 7 working days. Your deposit is never forfeited in full as a penalty, and if we cannot obtain the item after all, the whole deposit is returned to you. Arrival times we give are honest estimates based on the supplier and the shipping route, not guarantees. We deliver the item in its original sealed packaging, and once it is delivered the 14-day return window for unopened, factory-sealed goods in our Return & Refund Policy applies to a custom order exactly as it applies to anything else we sell; nothing in this section limits your rights as a consumer under the Egyptian Consumer Protection Law No. 181 of 2018.

تحكم هذه الشروط والأحكام («الشروط») وصولك إلى الموقع yourdoctor-eg.com واستخدامك له، وكذلك جميع ما يتّصل به من محتوى وميزات ومنتجات وخدمات («الخدمات») التي تُشغّلها YourDoctor («YourDoctor» أو «نحن» أو «لنا» أو «الخاص بنا»). ويُستضاف متجرنا على منصّة Shopify. وبدخولك إلى الخدمات أو استخدامها أو بتقديمك لطلب شراء، فإنك توافق على الالتزام بهذه الشروط وبـسياسة الخصوصية وسياسة الاسترجاع والاستبدال الخاصّتين بنا، وهما جزء لا يتجزّأ من هذه الشروط بالإحالة. وإذا كنت لا توافق، فيُرجى عدم استخدام الخدمات.

١. الأهلية والحسابات

يجب أن تكون بالغًا سنّ الرشد في نطاق ولايتك القضائية، أو أن تستخدم الخدمات تحت إشراف أحد الوالدين أو الوصيّ القانوني، لتقديم أي طلب. وإذا أنشأت حسابًا، فإنك توافق على تقديم معلومات دقيقة وكاملة وتحديثها باستمرار. وأنت مسؤول عن الحفاظ على سرّية بيانات دخول حسابك وعن جميع الأنشطة التي تتمّ من خلاله. ويُرجى إخطارنا فورًا بأي استخدام غير مصرّح به.

٢. المنتجات والأوصاف والتوافر

نحرص على وصف منتجاتنا وعرضها بدقّة. ومع ذلك، لا نضمن أن تكون أوصاف المنتجات أو ألوانها أو صورها أو المحتوى الآخر دقيقةً أو كاملةً أو خاليةً من الأخطاء دائمًا؛ وقد تختلف الألوان والتغليف الفعليّان. وتخضع جميع المنتجات للتوافر، ويجوز لنا تحديد الكميات أو إيقاف أي منتج أو تعديل تشكيلتنا في أي وقت قبل قبول طلبك، دون أي مسؤولية تجاهك.

بائع تجزئة مستقل بلا أي ارتباط. YourDoctor بائع تجزئة مستقل لمنتجات أصلية تُستورد مختومة في عبواتها. ونحن نشتري ما نبيعه عبر قنوات تجارية اعتيادية ونعيد بيعه في مصر. وأسماء العلامات التجارية وشعاراتها وعبواتها الظاهرة على الخدمات هي علامات تجارية مملوكة لأصحابها، ولا نستخدمها إلا للتعريف بالمنتجات التي نبيعها. وYourDoctor ليست تابعة لأي علامة تجارية ولا معتمدة منها ولا برعايتها، وليست وكيلًا أو موزّعًا أو ممثّلًا لأي علامة تجارية. انظر صفحة العلامات التجارية والماركات.

التنبيه عند توفّر المنتج. إذا نفد منتج أو أحد أنواعه، يمكنك ترك بريدك الإلكتروني أو رقم هاتفك ليصلك تنبيه عند عودته. ونستخدم هذه البيانات لهذا الغرض وحده: نرسل إليك رسالة واحدة عند توفّر المنتج، ولا نضيفك بسببها إلى أي قائمة تسويقية. ويمكنك أن تطلب حذف بياناتك في أي وقت، ونحذفها بمجرّد إرسال التنبيه أو بعد 12 شهرًا، أيّهما أقرب. وتَرِد الشروط الكاملة لهذه البيانات في سياسة الخصوصية. والتنبيه ليس حجزًا ولا يحتفظ لك بالمنتج.

٣. الأسعار

تُعرض الأسعار بالجنيه المصري (EGP) وهي السعر الإجمالي المستحقّ ما لم يُذكر خلاف ذلك عند إتمام الشراء. وتُعرض رسوم التوصيل، حيثما وُجدت، بشكل منفصل عند إتمام الشراء قبل تأكيدك للطلب. ونبذل قصارى جهدنا لضمان دقّة الأسعار، غير أنّ الأخطاء قد تقع. وإذا اكتشفنا خطأً في السعر يؤثّر على طلبك، فسنتواصل معك ونمنحك خيار المتابعة بالسعر الصحيح أو إلغاء الطلب. ويجوز لنا تغيير أسعارنا في أي وقت، غير أنّ السعر المعروض وقت تقديمك للطلب هو سعر ذلك الطلب، إلا في حالة تصحيح خطأ سعري ظاهر على النحو الموضّح أعلاه.

٤. الطلبات وقبولها

يُعدّ طلبك عرضًا للشراء، وتخضع جميع الطلبات لقبولنا. ويجوز لنا قبول أي طلب أو رفضه، كليًّا أو جزئيًّا، كما يجوز لنا إلغاء الطلب بعد قبوله في حالات تشمل الاشتباه في الاحتيال، أو الأخطاء في السعر أو المخزون، أو حيثما يقتضي القانون ذلك. وفي حال إلغاء الطلب بعد سدادك للمبلغ، فسنردّ المبلغ المعني وفقًا لـسياسة الاسترجاع والاستبدال. وإذا احتجت إلى تعديل طلبك أو إلغائه، تواصل معنا في أقرب وقت ممكن عبر واتساب على الرقم ‎+20 113 014 7058 أو على support@yourdoctor-eg.com، إذ تُرسَل الطلبات إلى شركة التوصيل بعد تقديمها بوقت قصير.

٥. الدفع

الدفع عند الاستلام هو وسيلة الدفع الوحيدة التي نوفّرها. ولا يوجد دفع إلكتروني عند إتمام الشراء: يُستحقّ إجمالي الطلب كاملًا، بما في ذلك أي رسوم توصيل ظاهرة عند إتمام الشراء، نقدًا لمندوب التوصيل لحظة تسليم الطلب إليك. ويُرجى تجهيز المبلغ بالضبط. ونحن لا نطلب أي بيانات بطاقة أو بيانات بنكية لتحصيل قيمة طلب عادي ولا نتلقّاها ولا نحتفظ بها، ولن نطلب منك بيانات بطاقة عبر واتساب أو البريد الإلكتروني أو الهاتف أبدًا.

والدفعة الوحيدة التي تسبق التسليم هي عربون الطلب الخاص (البندان ٨ و٢٥). وتدفعه عبر إنستاباي أو تحويل بنكي بعد قبولك الإجمالي الذي نرسله إليك، ويظلّ باقي المبلغ مستحقًا نقدًا لمندوب التوصيل عند الاستلام. وإذا أضفنا طريقة دفع أخرى مستقبلًا، فسنحدّث هذه الشروط قبل تفعيلها.

٦. الشحن والتوصيل

والمدة التقديرية للتوصيل حسب المنطقة: من 2 إلى 4 أيام عمل للقاهرة والجيزة، ومن 4 إلى 6 للإسكندرية والبحيرة، ومن 4 إلى 7 للدلتا والقناة، ومن 5 إلى 9 للصعيد، ومن 7 إلى 10 للبحر الأحمر وسيناء (وتبيّن سياسة الشحن رسوم كل منطقة)، وقد تمتدّ حول العطلات الرسمية والدينية (مثل عيد الفطر وعيد الأضحى). ومواعيد التوصيل تقديرية وغير مضمونة. ولا نقدّم رابط تتبّع مباشر لشركة التوصيل؛ وتُقدَّم تحديثات الحالة من شركة التوصيل عبر الهاتف أو واتساب، ومنّا عبر بريد إلكتروني بحالة الطلب. وتَرِد التفاصيل الكاملة في سياسة الشحن. ويُرجى التأكّد من وجود من يستلم الطلب على العنوان المُقدَّم. ولا يمسّ هذا البند حقوقك القانونية بصفتك مستهلكًا بموجب القانون المصري.

٧. الاسترجاع والاستبدال واسترداد المبالغ

تخضع عمليات الاسترجاع واسترداد المبالغ لـسياسة الاسترجاع والاستبدال الخاصة بنا، وهي جزء من هذه الشروط وتوضّح حقوقك والمدد المطبَّقة (بما في ذلك مهلة ١٤ يومًا لإرجاع المنتجات غير المفتوحة والمختومة من المصنع، ومهلة ٤٨ ساعة للإبلاغ عن منتج تالف أو خاطئ أو معيب) وكيفية تقديم الطلب: عبر واتساب على الرقم ‎+20 113 014 7058 أو على support@yourdoctor-eg.com. وبما أنّ كل طلب يُدفَع نقدًا عند الاستلام، فإنّ المبلغ يُردّ إليك إمّا نقدًا عند استلام المندوب للمنتج المُرتجَع، وإمّا عبر إنستاباي أو تحويل بنكي خلال 7 أيام عمل إذا تعذّر التسليم النقدي. ولا تُقيّد أيٌّ من بنود هذه الشروط حقوقك القانونية بصفتك مستهلكًا بموجب قانون حماية المستهلك المصري رقم 181 لسنة 2018 ولائحته التنفيذية.

٨. الطلبات الخاصة

يمكنك أن تطلب منّا إحضار أي منتج تجميل أو عناية بالبشرة أو عناية شخصية غير معروض على موقعنا. أرسل إلينا اسم المنتج ورابطه أو صورة له والكمية وأي تفاصيل مثل درجة اللون أو الحجم عبر صفحة الطلب الخاص. ونراجع الطلب عادةً خلال يوم إلى ثلاثة أيام عمل، ثم نرسل إليك الإجمالي عبر واتساب أو البريد الإلكتروني؛ ويشمل الإجمالي سعر المنتج والشحن ورسوم الطلب الخاص. وإذا قبلت، تدفع عربونًا لا يقلّ عن 40% من ذلك الإجمالي عبر إنستاباي أو تحويل بنكي، ونشتري المنتج من الخارج ونستورده مختومًا في عبوته، ويُدفَع باقي المبلغ نقدًا لمندوب التوصيل عند الاستلام. ويُقدَّم الطلب الخاص إليك بصفتك مستهلكًا ولاستخدامك الشخصي، ونحن نوفّر منتجات التجميل والعناية بالبشرة والعناية الشخصية فقط: فلا نوفّر أدوية ولا مستحضرات تُصرَف بوصفة طبية ولا مكمّلات تستلزم وصفة ولا أي صنف يُقيَّد استيراده إلى مصر أو يُحظَر، ونرفض أي طلب من هذا النوع. وبمجرّد تسليم المنتج إليك، تسري عليه جميع هذه الشروط بالطريقة المعتادة، بما في ذلك البنود ٥ (الدفع) و٧ (الاسترجاع والاستبدال واسترداد المبالغ) و٢٥ (عرابين الطلبات الخاصة).

٩. الملكية الفكرية

جميع المحتويات الموجودة على الخدمات: بما في ذلك اسم YourDoctor وشعارها والنصوص والرسومات والصور والتصميمات وترتيبها: مملوكة لـ YourDoctor أو مرخّصة لها، وهي محمية بموجب قوانين الملكية الفكرية. ونمنحك ترخيصًا محدودًا وغير حصري وغير قابل للنقل للوصول إلى الخدمات واستخدامها لأغراض شخصية وغير تجارية. ولا يجوز لك نسخ أي محتوى أو إعادة إنتاجه أو تعديله أو توزيعه أو استغلاله تجاريًّا دون إذن كتابي مسبق منّا.

علامات الأطراف الثالثة التجارية. أسماء العلامات التجارية وشعاراتها وعبواتها التي تظهر على الخدمات مملوكة لأصحابها، ولا نستخدمها إلا للتعريف بالمنتجات الأصلية التي نبيعها. ولا ينقل أي شيء على الخدمات أي حق في تلك العلامات إلينا أو إليك، ولا يعني أي شيء فيها أن YourDoctor تابعة لأي علامة تجارية أو معتمدة منها أو برعايتها. وYourDoctor بائع تجزئة مستقل لمنتجات أصلية تُستورد مختومة في عبواتها. ولأصحاب العلامات التجارية أن يراسلونا على support@yourdoctor-eg.com بشأن أي استفسار عن طريقة ظهور علاماتهم هنا؛ وانظر صفحة العلامات التجارية والماركات.

١٠. المحتوى المُقدَّم من المستخدم

إذا قدّمت محتوى إلى الخدمات (مثل المراجعات أو الصور أو التعليقات)، فإنك تمنح YourDoctor ترخيصًا غير حصري وخاليًا من الإتاوات وعالميًّا لاستخدام ذلك المحتوى وعرضه وإعادة إنتاجه وتكييفه فيما يتّصل بالخدمات وأنشطتنا التسويقية. وأنت تُقرّ بأنك تملك ذلك المحتوى أو لديك الحق في تقديمه، وبأنه لا ينتهك حقوق الآخرين أو يخالف أي قانون. ويجوز لنا إزالة المحتوى وفق تقديرنا. ويمكنك أن تطلب منّا التوقّف عن استخدام المحتوى الذي قدّمته في أي وقت بالكتابة إلى support@yourdoctor-eg.com، فنتوقّف عن استخدامه في أي مواد جديدة.

١١. الاستخدام المقبول

توافق على عدم استخدام الخدمات لأي غرض غير قانوني أو محظور، بما في ذلك: مخالفة أي قانون؛ أو انتهاك حقوقنا أو حقوق الآخرين؛ أو تقديم معلومات كاذبة أو مضلِّلة، بما في ذلك في طلب توريد خاص؛ أو التدخّل في الخدمات أو أمانها أو تعطيلها؛ أو محاولة الوصول غير المصرّح به إلى أي نظام أو حساب؛ أو استخدام الخدمات لبثّ برامج ضارّة. ويجوز لنا تعليق الوصول أو إنهاؤه عند مخالفة هذه الشروط.

١٢. روابط الأطراف الثالثة

قد تحتوي الخدمات على روابط لمواقع أو خدمات تابعة لأطراف ثالثة لا نتحكّم بها، بما في ذلك واتساب. ولسنا مسؤولين عن محتواها أو سياساتها أو ممارساتها، ولا يُعدّ إدراجها تأييدًا منّا لها. واستخدامك لمواقع الأطراف الثالثة يكون على مسؤوليتك الخاصة ويخضع لشروطها.

١٣. إخلاء المسؤولية

تُقدَّم الخدمات والمنتجات «كما هي» و«حسب توافرها». وإلى أقصى حدّ يسمح به القانون، نُخلي مسؤوليتنا عن جميع الضمانات غير المنصوص عليها صراحةً في هذه الشروط، سواء كانت صريحة أو ضمنية. ولا نضمن أن تكون الخدمات دون انقطاع أو آمنة أو خالية من الأخطاء. ولا يستثني هذا البند أو يُقيّد أي ضمان أو كفالة أو حق لا يمكن استثناؤه أو تقييده بموجب القانون المصري المعمول به، بما في ذلك حقوقك القانونية بصفتك مستهلكًا.

١٤. تحديد المسؤولية

إلى أقصى حدّ يسمح به القانون، لن تكون YourDoctor مسؤولة عن أي خسارة غير مباشرة أو عرَضية أو خاصة أو تبعية، أو عن فوات الأرباح، الناشئة عن استخدامك للخدمات أو المتّصلة به. ولن تتجاوز مسؤوليتنا الإجمالية الناشئة عن أي طلب أو المتّصلة به المبلغ الذي دفعته مقابل ذلك الطلب. ولا تستثني أيٌّ من بنود هذه الشروط أو تُقيّد مسؤوليتنا عن الوفاة أو الإصابة الجسدية الناتجة عن إهمالنا، أو عن الغشّ أو الاحتيال أو الإهمال الجسيم، أو عن أي مسؤولية لا يمكن استثناؤها أو تقييدها بموجب القانون المصري المعمول به، بما في ذلك قانون حماية المستهلك رقم 181 لسنة 2018.

ولمّا كان كل طلب يُدفَع نقدًا عند الاستلام، فإنّ أي مبلغ نستحقّه لك بموجب هذه الشروط يُردّ بالطرق الواردة في سياسة الاسترجاع واسترداد المبالغ: نقدًا عند استلام المندوب للمنتج، أو عبر إنستاباي أو تحويل بنكي خلال 7 أيام عمل. ونحن لا نحتفظ ببيانات بطاقات ولا يمكننا عكس أي دفعة بالبطاقة، ولذلك لا يجوز تفسير أي بند من هذه الشروط على أنه وعد بردّ المبلغ إلى بطاقة أو بأي وسيلة دفع لا نُشغّلها.

١٥. التعويض

توافق على تعويض YourDoctor ومسؤوليها وموظّفيها وشركائها وحمايتهم من أي مطالبات أو خسائر أو التزامات أو نفقات (بما في ذلك الأتعاب القانونية المعقولة) الناشئة عن مخالفتك لهذه الشروط، أو إساءة استخدامك للخدمات، أو انتهاكك لأي قانون أو لحقوق طرف ثالث. ولا يسري ذلك على أي مطالبة تنشأ عن فعلنا أو امتناعنا، ولا يُلزمك أيٌّ من بنود هذا القسم بتعويضنا عن الاستخدام العادي للخدمات أو عن ممارستك لحق يمنحه لك القانون. وأي مبلغ يُطالَب به بموجب هذا القسم يقتصر على الضرر الذي نتكبّده فعلًا، ويُخصم منه ما كان بوسعنا تفاديه بشكل معقول، ولا يمتدّ أبدًا إلى الخسائر غير المباشرة أو التبعية.

١٦. الخصوصية

يخضع استخدامك للخدمات أيضًا لـسياسة الخصوصية الخاصة بنا، التي توضّح كيفية جمعنا لمعلوماتك الشخصية واستخدامها وحمايتها.

١٧. الإنهاء

يجوز لنا تعليق وصولك إلى الخدمات أو إنهاؤه في أي وقت، بإشعار أو دونه، إذا خالفت هذه الشروط أو حيثما نرى بشكل معقول أنّ ذلك ضروري لحماية الخدمات أو المستخدمين الآخرين أو حقوقنا. وتظلّ سارية البنود التي ينبغي بطبيعتها أن تبقى بعد الإنهاء: بما في ذلك الملكية الفكرية وإخلاء المسؤولية وتحديد المسؤولية والتعويض والقانون الواجب التطبيق. ولا يترتّب على تعليق وصولك أو إنهائه إلغاء طلب قبلناه بالفعل.

١٨. التعديلات على هذه الشروط

قد نُحدّث هذه الشروط من وقت لآخر لتعكس تغييرات في ممارساتنا أو لأسباب تشغيلية أو قانونية أو تنظيمية. ويُنشَر أي تغيير كإصدار جديد له رقم إصدار وتاريخ سريان خاصّان به، وتحكم كلَّ طلب النسخةُ السارية وقت تقديمه. ونُخطرك بالتغيير قبل سريانه على هذه الصفحة. وتسري التغييرات اعتبارًا من تاريخ السريان فقط، ولا تمسّ طلبًا قُدِّم بالفعل.

١٩. القوة القاهرة

لسنا مسؤولين عن أي إخفاق أو تأخير في أداء التزاماتنا إذا كان ناتجًا عن أحداث خارجة عن سيطرتنا المعقولة، بما في ذلك الظواهر الطبيعية، أو الإضرابات، أو أعطال شبكات الاتصالات أو الخدمات اللوجستية، أو الإجراءات الحكومية، أو غيرها من ظروف القوة القاهرة.

٢٠. القانون الواجب التطبيق والاختصاص القضائي

تخضع هذه الشروط لقوانين جمهورية مصر العربية. ويُنظر أي نزاع بشأنها أو بشأن الخدمات أمام المحاكم المختصّة بمدينة القاهرة. ويجوز لك أيضًا تقديم شكوى مجانًا إلى جهاز حماية المستهلك المصري بشأن أي أمر يتعلق بهذه الشروط أو بأي طلب. ولا يُسقط تقديم الشكوى إلى الجهاز حقّك في اللجوء إلى القضاء.

٢١. أحكام عامة

تُشكّل هذه الشروط، مع السياسات المُشار إليها فيها، الاتفاق الكامل بينك وبين YourDoctor بشأن الخدمات، دون الإخلال بالمعلومات التي يوجب القانون تقديمها إليك قبل الشراء، ولا بأي حق مقرَّر لك بصفتك مستهلكًا بموجب القانون المصري. وإذا تبيّن أنّ أي بند غير قابل للنفاذ، تظلّ البنود المتبقّية سارية بالكامل. ولا يُعدّ تقاعسنا عن إنفاذ أي حق أو بند تنازلًا عنه. ولا يجوز لك التنازل عن هذه الشروط دون موافقتنا؛ ويجوز لنا التنازل عنها في إطار نقل نشاط تجاري. وتُنشَر هذه الشروط باللغتين الإنجليزية والعربية، وللنصّين الأثر ذاته؛ وعند اختلافهما، يُؤخذ بالتفسير الأكثر مصلحةً لك بصفتك مستهلكًا.

٢٢. استخدام المنتجات والصحة والسلامة

YourDoctor متجر إلكتروني لبيع مستحضرات تجميل وعناية بالبشرة ومنتجات عناية شخصية مستوردة. نحن لسنا صيدلية، ولا يعمل ضمن فريقنا أي طبيب أو صيدلي أو أخصائي جلدية أو أي متخصص رعاية صحية آخر. لا يُعدّ أي محتوى على الخدمات، أو في وصف أي منتج، أو على قنواتنا الاجتماعية، أو صادر عن مرشد المنتجات الذكي (البند ٢٤) استشارة طبية أو تشخيصًا أو بديلًا عن استشارة طبيب أو صيدلي مؤهَّل: استشر طبيبك دائمًا قبل الاستخدام إذا كنتِ حاملًا أو مرضعة، أو تعاني من حالة جلدية، أو تستخدم علاجًا موصوفًا، أو لست متأكدًا من ملاءمة المنتج لك.

قبل الاستخدام الأول لأي منتج جديد، قم باختبار حساسية موضعي: ضع كمية صغيرة على منطقة سليمة من الجلد (مثل باطن الساعد) وانتظر ٢٤-٤٨ ساعة. أوقف الاستخدام فورًا واطلب عناية طبية إذا شعرت باحمرار أو حكة أو حرقان أو تورم أو أي علامة تحسّس أو تهيّج أخرى. اقرأ دائمًا ملصق المنتج وتعليمات الشركة المصنِّعة قبل الاستخدام، بما في ذلك تركيزات المكوّنات الفعّالة وتكرار الاستخدام واحتياطات التعرّض للشمس. المنتجات المحتوية على الريتينويد أو الريتينول أو مكوّنات مشابهة، وأي منتج نصنّفه كدواء يُصرف دون وصفة طبية (البند ٢٣)، غير مخصّصة لمن هم دون ١٨ عامًا ولا يجب استخدامها أثناء الحمل أو الرضاعة دون استشارة الطبيب أولًا.

٢٣. الوضع التنظيمي للمنتجات

المنتجات التي تبيعها YourDoctor هي منتجات أصلية ومختومة مستوردة من الولايات المتحدة الأمريكية (أو بلد المنشأ المُعلَن من العلامة التجارية)، ولا نقوم بتصنيعها أو إعادة تركيبها أو إعادة تعبئتها. ويكون وضعها التنظيمي كالتالي:

  • مستحضرات التجميل (وهي أغلب منتجاتنا) لا تخضع، ولا يمكن أن تخضع، لـ«موافقة إدارة الغذاء والدواء الأمريكية (FDA)»: إذ لا تُصدر هذه الإدارة موافقات مسبقة على مستحضرات التجميل قبل طرحها في السوق. وكون المنتج التجميلي أصليًا ومستوردًا مختومًا من الولايات المتحدة لا يعني حصوله على موافقة FDA، لأن هذه الموافقة غير موجودة أصلًا لهذه الفئة من المنتجات.
  • بعض المنتجات (مثل علاجات حب الشباب المحتوية على بنزويل بيروكسايد كمنتجات PanOxyl) تُصنَّف في الولايات المتحدة كـأدوية تُصرف دون وصفة طبية (OTC) بموجب دليل FDA للأدوية التي تُصرف دون وصفة. وتتبع هذه المنتجات مواصفات ملصقها الأمريكي، بما في ذلك لوحة بيانات الدواء (Drug Facts) والتعليمات والتحذيرات المطبوعة على العبوة؛ ولا نقوم بتعديل أو ترجمة هذا الملصق.
  • الوضع التنظيمي في مصر: نبيع منتجات التجميل والعناية بالبشرة والعناية الشخصية فقط. ولا نبيع أدوية ولا مستحضرات تُصرَف بوصفة طبية ولا أجهزة طبية، ونرفض أي صنف يُقيَّد استيراده إلى مصر أو يُحظَر من هيئة الدواء المصرية (EDA) أو من أي جهة مختصة أخرى. والمنتجات التي نبيعها أصلية، تُشترى عبر القنوات التجارية المعتادة وتُستورَد مختومة في عبواتها الأصلية. ولا نحمل أي توكيل أو وكالة أو حق توزيع أو ترخيص من أي علامة تجارية، ولا نُقرّ بحصولنا على أي تسجيل مصري بشأن منتج بعينه. وإذا أبلغتنا جهة مختصة بأنّ منتجًا لا يجوز عرضه للبيع في مصر، سحبناه من البيع.

٢٤. المساعد الذكي / مرشد المنتجات

حيثما يكون مفعّلًا، يوفّر موقعنا مساعدًا ذكيًا آليًا («مرشد المنتجات») يجيب عن أسئلة عامة حول منتجاتنا ومتجرنا. هذا المساعد هو برنامج آلي، وليس شخصًا، وليس متخصصًا في الرعاية الصحية. تُستمَدّ إجاباته من معلومات المنتجات المتاحة ومعرفة عامة، وهي مُقدَّمة لأغراض إعلامية عامة فقط، وقد تكون ناقصة أو قديمة أو غير صحيحة، ولا تُعدّ أبدًا استشارة طبية أو بديلًا عن استشارة طبيب أو صيدلي مؤهَّل. لا ينبغي أن تعتمد على إجابة المساعد وحدها كأساس لقرار شراء أو قرار متعلّق بصحتك؛ وعند الشك، تواصل مع فريقنا عبر واتساب على +20 113 014 7058 أو اسأل طبيبك.

نُسجّل محادثاتك مع المساعد لتشغيل هذه الميزة ومراجعتها وتحسينها، على النحو الموضّح في سياسة الخصوصية. وإلى أقصى حدّ يسمح به القانون، تقتصر مسؤوليتنا عن أي خسارة ناشئة عن استخدامك للمساعد الذكي أو اعتمادك عليه على قيمة الطلب المرتبط بتلك المحادثة (أو تُستبعد كليًا إن لم يوجد طلب مرتبط، إلى أقصى حدّ يجيزه القانون)، ولسنا مسؤولين عن أي خسارة ناشئة عن إساءة استخدامك للمساعد، بما في ذلك تزويده بمعلومات كاذبة أو استخدام مخرجاته لغرض لم يُصمَّم من أجله. ولا يُقيّد هذا البند أي مسؤولية لا يجوز استبعادها بموجب القانون المصري.

٢٥. عرابين الطلبات الخاصة

يمكنك الإلغاء واسترداد عربونك كاملًا في أي وقت قبل شرائنا للمنتج من الخارج. وبعد الشراء، نردّ إليك العربون بعد خصم التكاليف التي تحمّلناها فعليًّا وبشكل معقول على طلبك فقط (ثمن المنتج لدى المورّد إذا تعذّر استرداده، وأجرة الشحن الدولي المدفوعة بالفعل، وأي رسوم جمركية أو تخليص سُدِّدت بالفعل)؛ ونعرض عليك مستند كل تكلفة نخصمها، ولا نخصم سواها، ونردّ الباقي خلال 7 أيام عمل. ولا يسقط عربونك بالكامل بوصفه غرامة في أي حال، وإذا تعذّر علينا الحصول على المنتج في النهاية يُردّ إليك العربون كاملًا. والمدد التي نذكرها للوصول تقديرات صادقة مبنيّة على المورّد وخط الشحن، وليست ضمانات. ونسلّمك المنتج في عبوته الأصلية المختومة، وبمجرّد التسليم تسري على الطلب الخاص مهلة الاسترجاع البالغة 14 يومًا للمنتجات غير المفتوحة المختومة من المصنع الواردة في سياسة الاسترجاع واسترداد المبالغ تمامًا كما تسري على أي منتج آخر نبيعه؛ ولا يُقيّد هذا البند حقوقك بصفتك مستهلكًا بموجب قانون حماية المستهلك المصري رقم 181 لسنة 2018.
